• CRM setup and lead flow automation

• Conversational AI bots

• Landing page creation

• SMS/MMS marketing and A2P messaging tools

• Business growth and retention tools

All services are provided through our proprietary system and/or white-label SaaS platform.

3. Eligibility

You must be at least 18 years old and a legally registered business or authorized representative to use Pattern85 services.

4. User Responsibilities

By using our services, you agree to:

• Provide accurate, up-to-date information during sign-up

• Maintain the security of your login credentials

• Comply with applicable laws (including but not limited to TCPA, CAN-SPAM, CTIA, and A2P 10DLC guidelines)

• Obtain proper consent before sending messages to your contacts via SMS, MMS, or email

You are solely responsible for the content and legal compliance of all communications sent through our platform.

5. Messaging Compliance & Consent

If you use our SMS/MMS features:

• You must obtain express written consent from each recipient before sending messages

• Opt-in must be verifiable and properly logged

• Every message must include a way to opt-out (e.g., “Reply STOP to unsubscribe”)

• We may suspend or terminate your account if you abuse our platform or violate carrier regulations

6. Payments & Refund Policy

Services may be offered as subscriptions, one-time fees, or retainers. All fees are clearly disclosed at the time of purchase.

• Payments are due upfront and billed monthly or annually based on your selected plan

• We offer a 10-day money-back guarantee on most subscription plans unless otherwise stated

• No refunds will be issued for services already rendered

Late payments may result in suspension of services until the balance is paid.

7. Intellectual Property

All content, branding, design, and code provided by Pattern85—including training materials, automations, landing pages, templates, and marketing tools—remain our intellectual property. You may not copy, resell, or distribute our proprietary systems without explicit written permission.

You retain ownership of your business data, customer information, and original uploaded content.

8. Termination

We reserve the right to suspend or terminate your access to services at our sole discretion if:

• You breach these Terms

• You violate A2P or carrier regulations

• You engage in fraudulent, misleading, or abusive behavior

• You fail to pay invoices

You may cancel your account at any time by contacting [email protected]. Upon termination, your access will be revoked and stored data may be deleted.

9. Limitation of Liability

To the maximum extent permitted by law, Pattern85 is not liable for:

• Lost profits or business opportunities

• Delayed or failed messages

• System outages or errors

• Regulatory fines from improper usage of our platform

Our total liability will never exceed the amount paid by you in the past 90 days.

10. Indemnification

You agree to indemnify and hold Pattern85, its affiliates, officers, and employees harmless from any claims, damages, or legal disputes arising from your use of our services, including any violation of messaging laws or third-party rights.

11. Governing Law

These Terms are governed by and construed in accordance with the laws of the State of New York. Any disputes shall be resolved exclusively in courts located in New York City, NY.
